Case Caption: Katilas, et al. v. Ferguson Enterprise of South Carolina Co., Inc.

Court: Circuit Court for Baltimore City, Case# 24-C-99-00416

Facts: On September 16, 1996, Plaintiff and her minor daughter, while stopped at a red light at the intersection of Route 24 and Singer Road in Harford County, Maryland, were rear-ended by Defendant Bryan, an employee of Ferguson Enterprise of South Carolina Co., Inc., who was attempting to use a car phone.

Allegations of Liability: Negligence

Injuries/Damages: Mother incurred approximately $20,000.00 in medicals and approximately $12,000.00 in lost wages, and minor daughter, age 1, incurred approximately $41,000.00 in medicals. Mother sustained: cervical and lumbar injuries, multiple facial, chest and arm lacerations, orbital floor fracture, deviated septum, eye trauma resulting in optical floaters, 29 heavy gauge staples in her head (closed head injury), right knee and hand injuries, left thumb injury, multiple leg and back contusions and lacerations. Minor child sustained: head contusions and lacerations, emotional trauma.

Plaintiff's Expert: Dr. Bruce Russell, Orthopedic Surgeon.

Special Remarks: Accident occurred in Harford County. Case was filed in Baltimore City. Prior to pre-trial, no offer was made by Defendant. At pre-trial, Defendant initially offered $150,000.00 to settle the case. Case settled one (1) day after pre-trial conference for $500,000.00.
